    It is private property. the Government can't do anything due to the Constitution.

    You just have to deal with it or move.

    Smoke rises, it is odd that the wind would be blowing her smoke directly to your windows every single day from upstairs. If you live in one of the states with the smoking ban, you could talk to your landlord about enforcing it. Or speak to her about where she goes at to smoke.

    if you are downstairs, how you are getting the smoke ?

    Smoke, since it comes from something burning normally rises, it doesn't fall.

    Generally when people get irrational about their neighbours minor but annoying behaviour, it is because they are using the issue as a reason not to confront their own personal problems.

    Have you considered getting psychiatric help ?

    That might be your best long term solution.

    you could close the windows and turn on the AC instead of using fans,and leaving the windows open,, if your windows leak get the landlord to install new seals..
    Otherwise just move no one is forcing you to live there..
    Maybe you should be thankful she goes outside to smoke,she could just smoke inside and eventually the smell would start seeping down through her floor and coming out your ceiling

    its better she smokes outside than inside

    at least shes outside dont like it move

    she has as much right to smoke on her porch as you do to not smoke

    Don't use the breeze as your air conditioner.
    Keep your windows closed if it's such a problem to you.

    or if you don't like it, use febreze. They have one for air now, not just fabric.
    If you don't like all the crazy smells they have simple ones like linen and sky. My favorite one is Brazilian carnival.

    If you want to continue to live there, you're just going to have to get used to it.

    move to a non smoking community their are several of them out their and the rent is normally cheaper and the tenants are normally better
