This is a case when both parties are at fault. If the driver of the car ran the stop sign, then he is responsible for failing to stop. The fact that your brother was riding his bike on the wrong side of the road puts him at fault as well. A bike is considered a vehicle just the same as a car. The bike must travel in the proper lanes, signal turns by using hand signals and obey all other traffic laws. Once he got on his bike and rode on a highway, he was no longer considered a pedestrian. Hopefully your brother was not hurt seriously and bike repair is the only cost he will realize. Riding a bike to work can be very safe but the rules of the road must be adhered to by all. I believe both parties had some blame. If the driver fled the scene of the accident, that person definitely deserves a ticket. How the insurance company settles these matters when both have fault, is a mystery to me. If your brother does not have auto insurance, he may be able to have his home owner's or renter's insurance company plead in his behalf. If he is uninsured by any of these, contact your state's attorney generals office. They will provide assistance.
in a court case the fact he wasn't on the right side of the road would probably loose it for him
WOW so wrong!!!!!! the driver is at fault, well both are really. but the driver has more fault.. take the case to court, and to win money tell your brother to fake injuries lol, if he doesnt have any.... lol but yeh your brother should of been smarter though regardless...
From what i understand, riding your bike has the same rules as driving a car, that you're supposed to signal and ride on the right side of the road. It's the idea of getting a speeding ticket while riding a bike or getting a DWI for riding a bike while intoxicated. However, i would also say that your brother is a pedestrian and that is considered a hit and run... that's a hard one. I would fight it because like i said, he is still a pedestrian and the driver left the scene. Maybe take a look at this website Hope this Helps, Vroom
ehh, its a police report, those are always done crappily...technicly both are at fault. He was on the wrong side of the road and that other guy ran a stopsign. Just because he was struck dosent mean he was not at fault
I'm sorry. I hope he recovers soon... But really it is partly your brother's fault, though I would say that the driver was more at fault than he...
The drivers fault
no matter what, the driver had the responsibility to be paying attention to the rode, obviously he wasnt and hit your brother. he was probably texting or talking on his phone. im sorry this happened.
