I have just written the following letter to Vodafone

On 16 Dec I ordered a Blackberry Bold phone on line and asked for it to be delivered
to the Vodafone shop in Exeter High Street. I called at the shop on 22 Dec to be told
that not only had my order not arrived but no trace of the order could be found.
I received two welcome e-mails telling me that I had joined Vodafone on 21 Dec,
giving me the phone number 07833 460080. As no phone has arrived I sent the
following e-mail on 24 December 2010 at 15:17

As you have failed to fulfil your part of the contract in failing to supply the
phone I ordered on the 16th Dec I wish to CANCEL the contract with immediate effect.

Kindly confirm that you have received this cancellation.

As I have not received any reply to this e-mail or any news from your company I
am writing to ask you to cancel ANY contract I have made with Vodafone and confirm
this in writing to me at the above address.'

I trust that this will assure you that as I cancelled within 7 days I have no liability.

Please advise me of my legal position on this matter
