I heard that in Canada any private lawyers can issue a subpoena without a judge's permission to get private information. Is this true? If that is the case, then if he/she wants to, the lawyer could get someone's private information by issuing a subpoena even if there is no actual lawsuit or a legal case that requires such information. Basically he/she could abuse his/her power to invade someone's privacy. Who is watching their behavior?
I heard many people saying lawyers can issue subpoenas without a judge's permission.
@me. This is one of the articles that I found when I searched on internet about it. Well it is only applicable in some states in the US, and I am not too sure about Canada. Read the section," Who May Initiate Subpoenas?" in the article. "http://www.zurinstitute.com/subpoena.html."
