I'm talking specifically about using it as *evidence*
But in the example above isn't the tape used as evidence too

Domestic CCTV does not need *signs* as it is not regulated by the DPA. Iccz link plus this one.
I was under the impression that without some sort of sign, the footage might not stand up in court - not worried about whether it is legal to have them up - happy to be wrong.
Can I 'drop' my wallet in my drive, use a hidden camera to catch the local scally stealing it, and then get him arrested?
I think PC footage doesn't stand up in court because it can be easily altered, although it can help Police with their inquiries however the video is obtained.
You can put CCTV up. No need for signs etc. if it captures someone committing an offence then is great evidence at court. It's a great investment if you ask me. Far better than a house alarm that everyone ignores if they go off

You dont need signs what so ever for it to be used as evidence.
You could even take a snap of them with your camera or mobile phone and use that too.
You can see it with your eyes and give a statement that can be used as evidence without having to tell them that they are being watched, so why not record what your eyes can see and use that also.
In fact even covert cameras/video is fone too, whether on private property or public.
The only thing you cant do is invade someones privacy* with it, the same as you cant do with your own eyes.
*privacy means anywhere that someone would reasonably expect to have privacy, whether in private or public. I.E a private dwelling, a swimming baths/clothes shop changing room, even a kid behind a towel on a packed beach.
