Unfortunately the law does not work in terms of percentages. What does and does not constitute a copyright violation takes a 2 credit class in law school to answer.
the short answer is "substantially similar," it's a legal standard that means the judge will decide on a case-by-case basis. If you have to ask, you're not creating a truly original work.
