My husband was told he had been hired pending background check. Employer had full name, birthdate, and ssn. they denied him based upon a background check that matched first/last name and birthdate. The middle name was different and there was no ssn. He was mistaken for a multiple felon and, even after re-showning his identification to the company to prove this is not him they refuse to fix it or hire him until he contacts the 3rd party and files a formal complaint with them and has them rerun the background check correctly. they are not guarenteeing a spot remain open for employeement. He hasn't officially 'lost' the job yet, but, by the time we have finished this, even if it works, the likelihood is, they will have no job openings. the background check they sent to us says they ran it only in FL and says "employment evaluation should not be based on search results" we have no residential history in FL. Do we have legal recourse?
