everyone does this, they wont sue you or put you in jail, same with downloading films and music.

So it's not going to lose Picasso any money to copy his paintings because he's already dead. Is that what you're saying? I believe the few people who own original Picasso's would vehemently disagree with you.
As long as the copyright's in place, it is illegal to copy. Whether they can or cannot profit from the copyright is not your concern. You cannot strip them of their right. There is no "squatter's rights" to copyright.
Whether you'll get caught or not is a completely different question.
